How Can I Be Charged With A Crime I Did Not Commit?
Aggravated Assault In most jurisdictions, aggravated assault is simply an assault where more serious bodily injury was intended or a deadly weapon was involved. One may also be charged with aggravated assault if the suspect showed a blatant indifference to human life. Aggravated assault often results in harsher penalties than simple assault. How can a person be charged with a crime that he did not commit? I applied for an apartment in Orlando, Florida, They called me back saying I could not get an apartment because of a felony that’s on my record, I told the person who called me, what felony? I never committed a felony and she said that yes, there is a felony on my record. I did my own background check, and to my surprise there it was AGGRAVATED ASSAULT AGAINST A PREGNANT WOMAN. That pissed me off because I have been with the same woman for about nine years and I have never struck her, let alone being pregnant. I went to the sheriffs office in the city where the charges where made to find out why this was on my record but, they did not find anything. I said to the sheriff that it is there, I did my own background and it showed up, she told me that those reports where not accurate that she did not know why employers, or landlords use those reports. They gave me a letter showing what was in my background and there was no felony, she told me to use that letter whenever I went to look for work, a house or apartment. I had about 20 interviews in the past month and half, when they ask me have I ever committed a felony I say no but that there is a felony showing in my record that I did not commit. Every time I mention it the interview gets cut short and they say, ok, if we are interested we will call you, yeah right, no word from them again. So, I did my own little test, when ever they asked me if I have a felony on my record I say no, and guess what the interview goes to the very end and I get called back. But when they see that there is a felony on my record say no, you lied we can’t hire you. Now, if that felony were not on my record I would have a decent job instead of working as a waiter for Ihop. Before, I would ask myself why do criminals who get a second chance continue that life of crime, now I know why, no employer would hire them so they get frustrated and keep selling drugs, stealing cars, mugging people, because society will not give them a second chance. I am not saying all criminals learn their lesson cause 80% of criminals get out and do it over and over again. If you read this and have some advice please share it with me, I don’t know what else to do. I don’t want to become a criminal that’s not me, but this frustration is pushing me to it. WHAT CAN I DO? PLEASE HELP
